Young German lawyers, often seeking a well-rounded legal education, frequently ask what the best way of completing legal study in the US is. Is this best achieved through additional study, a clerkship as part of the German "Referendariat" or through a research fellowship? There is no universal answer to this question.
It may prove to be difficult and less beneficial for a German law student to plan a stay in the US while still in law school in Germany. Going to the US while still in law school may not allow a more profound comparison of both legal systems, which is the cornerstone for a deeper academic insight. The more one is familiar with the German legal system and the more one is advanced in training, the easier and more beneficial the US experience will be. An appropriate time for a young German lawyer to go to the US to complete a course of study is after the First State Examination. However, planning to go to the US after completing the Second State Exam (“Assessorexamen”) is in no way too late.
